Stating that under Article 356, it was in the realm of the powers of the president and the parliament, Dravidar Kazhagam president Veeramani said the Supreme Court could not compel, recommend or suggest to the president to impose president`s rule.
Dravidar Kazhagam, the parent body of the ruling DMK in Tamil Nadu, Wednesday appealed to the Chief Justice of Supreme Court not to allow Justice B N Agarwal to hear the cases relating to Ram Sethu and the recent bandh.
DK president K Veeramani, in a letter to Chief Justice K G Balakrishnan, said Justice B N Agarwal had said that he would recommend the dismissal of Tamil Nadu government and imposition of president`s rule in the state.
The observations were opposed to the verdict of the Supreme Court in S R Bommai case and also against the provisions of the constitution of India, he said.
Stating that under Article 356, it was in the realm of the powers of the president and the parliament, Veeramani said the Supreme Court could not compel, recommend or suggest to the president to impose president`s rule.
"The observations made by the learned judge amounts to an attempt to interfere in the powers and functioning of the central government and the president", the DK leader said.
"It appears that the learned judge, by his conduct, has exhibited his anxiety and over enthusiasm and thereby made himself vulnerable."
"In the interest of justice, it would be appropriate that the learned judge does not hear the cases relating to Ram Sethu and the bandh", he said in his letter.
Talking to reporters while releasing his letter to the press, Veeramani said parliament should enact an amendment to remove contempt of court proceedings as such provisions were not required in a democracy.
Appealing to parliament to initiate impeachment proceedings against Justice Agarwal, he said he would mobilise people`s support for it. |
